By checking the box above, I acknowledge and agree to my voluntary participation as shown above in the OC87 Recovery Diaries Women Writer’s Retreat (the “Event”) under the terms and conditions as set forth in this Agreement.

I identify as female, aged eighteen (18) years or older.

I hereby grant to OC87 (its affiliates, subsidiaries, successors, assigns and licensees) the irrevocable right to use my name, likeness(es) and biographical material (after they are approved by me) in any manner whatsoever in any media whatsoever (whether now or hereafter known) in connection with the Event, as well as the irrevocable right use any copyrighted materials I provide or use in any way for or during the Event in connection with the Event and/or my participation in the aforesaid Participant’s Activity(ies) or otherwise. Therefore, for avoidance of any doubt, I hereby grant to OC87 an irrevocable, non-exclusive license, in perpetuity and worldwide, to use any and all copyrighted materials I provide and/or use for the Event, in connection with the Event, in any and all manner OC87 elects, and in any and all media whether such media is now or hereafter known or discovered and in any all formats or configurations whether now or hereafter known, without further compensation to me or any third party who derives rights from me.

I hereby warrant and represent that no use or provision of any copyrighted material or other intellectual property I provide and/or use for the Event, in connection with the Event or during the Event shall violate any third party(ies)’s rights.

I hereby warrant and represent that I am in at least good health, physically and emotionally, to attend and participate in this Event. If I have a health condition that may aggravated during this Event, I understand that it is my responsibility to disclose that to the Event organizer, i.e. OC87, prior to the Event and seek appropriate intervention. In the event of my illness or injury while I am participating in the Event, I hereby give my consent to whatever X-ray, examination, anesthetic, medical, surgical and/or dental diagnosis and/or treatment and/or hospital care from a licensed physician, surgeon, and/or dentist deemed necessary by OC87 for my safety and welfare. It is understood that any and all payment in connection with any and all resulting costs and expenses from any or all of the aforesaid will be my sole and entire responsibility.

I do hereby indemnify and hold completely harmless OC87 (which includes without limitation its successors, assigns, designees, employees, representatives, contractors, Board of Directors, other participants), from any and all liability(ies), damages, demands, losses, costs and/or expenses (including without limitation costs of defending claims and/or litigation) arising from or in connection with any claims, suits and/or causes of action either directly or indirectly related to, arising out of or in connection with my voluntary participation in the above-referenced Participant’s Activity (and/or any other activities in which I participate in connection with OC87 and/or the Event), including without limitation, physical, mental and/or emotional injury and/or harm, whether caused by me or by others or caused to me, and/or any theft, loss or damage I may cause or that is caused to me, and/or arising out of any violation of my warranties and representations made herein, e.g. violation of third party(ies)’s rights.

I hereby waive my right to a refund if cancellation occurs later than thirty (30) calendar days prior to the Event. Any cancellation of participation in the Event prior to thirty (30) calendar days prior to the event will result in a full refund, minus a seventy-five dollar ($75.00) cancellation fee.

OC87, Inc. reserves the right to cancel the Event at any time up to and including the day of the Event for any force majeure reason (e.g. Act of God, impracticability, impossibility, act of war, etc.), or if OC87 determines that the weather conditions would make holding the Event unsafe. In the event of a weather-related cancellation, a full refund will be issued to all participants.

I fully understand and agree that I am freely, i.e. of my own volition, participating in this and any other Event-related Activity(ies), and I am doing so without any promise of payment or any kind of material benefits whatsoever from OC87, and that I am strictly a participant in the Event.

By checking the box below this document on the Retreat Registration Form, I acknowledge that I have read and understand the above provisions and agree to abide by these terms and conditions.
